Do I assign the rights to my music, my home and my firstborn?
R1. No. The only rights we take are those we need to run the service. For example, the right to host the music you upload, to broadcast and sell it on your behalf, to display the lyrics and artwork you put on the site, etc. In addition, you give us the right to produce a compilation of different tracks to maximise sales on your behalf. What can I download? Are the covers OK?
R2. Before you can download, you must own or control all the rights to everything you download. This means that the covers are out unless you have a written license or permission from the artist to upload the cover to afro-riddimz and grant us the rights under the conditions below. Do not upload covers without obtaining all permissions and authorizations in writing! These requirements apply whether you sell the music or give it away.
Which artists can sell on afro-riddimz.com?
R3. Afro-riddimz gives priority to singers who are not represented by any music protection organization like GEMA, SACEM and others. If you are represented by a label, then the label should be the one that uploads the content for you.
How much does afro-riddimz cost?
R4. Creating an account on afro-riddimz is free. The artist receives 70% of any payment made on their product
Will my personal information be sold to a random third party advertiser?
When I buy something on afro-riddimz, does the artist I’m trying to support only receive a fraction of a fraction of what I pay?
The artist always receives 70% of the payment sent to the artist. 11% is for afro-riddimz, 19% for VAT. Afro-riddimz only makes money when the artist makes money. You can learn more by reading our fair music policy here and the section on fees below.

If you are using or opening an account on behalf of a company, entity or organization (including, but not limited to, a record label) (each, an “Artist Entity”), you represent and warrant that you :
The Service is only available to persons who are at least 18 years of age. You represent and warrant that if you are an individual, you are of legal age to enter into a binding contract and that all registration information you submit is accurate and truthful. The Company may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Service is revoked in those jurisdictions.

It is the responsibility of each User to verify that the personal information entered during the registration process is 100% correct (as when booking an airline ticket). All User information entered will be locked 14 days after registration and changes to this information can only be made in special circumstances, as further described in the Policies and Procedures.
Email Verification and Validation
Email validation, including verification of the identity of each affiliate who has registered with afro-riddimz, is part of the afro-riddimz registration process. The verification of the validity of the e-mail determines the level of access to the back office. Affiliates with non-validated email addresses have limited access to the back office.
Obligations, Responsibilities and Rights of Users
Rules and conduct
By way of example, and without limitation, you shall not (and shall not permit any third party to) either (a) take any action or (b) upload, download, post, submit or otherwise distribute or facilitate the distribution of any content on or through the Service, including, without limitation, any User Submission, that:
infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity or violates any law or contractual obligation;
you know to be false, misleading, deceptive or inaccurate;
is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive or profane;
constitutes unauthorised or unsolicited advertising, junk mail or spamming
involves commercial activities and/or sales without the Company’s prior written consent, such as contests, sweepstakes, barter, advertising or pyramid schemes;
exploits people in a sexual or violent manner;
contains software viruses or any other computer code, files or programs designed or intended to disrupt, damage, limit or interfere with the proper working of any computer software, hardware or telecommunications equipment or to damage or gain unauthorised access to any system, data, passwords or other information of the Company or any third party; or
impersonate any person or entity, including any employee or representative of the Company.
In addition, you must not:
take any action that imposes or may impose (as determined by the Company in its sole discretion) an unreasonable or disproportionately large load on the Company’s (or its third party suppliers’) infrastructure;
interfere or attempt to interfere with the proper working of the Service or any activity conducted on the Service;
circumvent any measures that the Company may use to prevent or restrict access to the Service (or other accounts, computer systems or networks connected to the Service);
run Maillist, Listserv, any form of autoresponder or “spam” on the Service; or (v) use any software, device or other manual or automated process to “crawl” or “spider” any page of the Site.
You must not (directly or indirectly):
decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms from any part of the Service, except to the limited extent that applicable law specifically prohibits such restriction;
modify, translate or otherwise create derivative works of any portion of the Service;
copy, rent, lease, distribute or otherwise transfer any of the rights you receive hereunder. You must comply with all applicable local, state, national and international laws and regulations.
The Company does not guarantee that any User Content or Submissions (as defined below) will be made available on the Site or through the Service. The Company has no obligation to monitor the Site, the Service, the Content or User Submissions. However, the Company reserves the right to (i) remove, edit or modify any Content in its sole discretion, including without limitation any User Submission, from the Site or Service at any time, without notice and for any reason whatsoever (including, without limitation, the right to remove, edit or modify any User Submission), and (ii) remove, edit or modify any User Submission from the Site or Service at any time, without notice and for any reason whatsoever.
The Company reserves the right to investigate and take appropriate legal action against anyone who, in the Company’s sole discretion, violates this provision, including, without limitation, termination of your account and/or reporting such activity or Content to law enforcement authorities.
Fan Personal Information – Fans.
As a condition of using certain features of the Service (including, without limitation, the free download feature or purchasing from the Company or an Artist), you may be required to provide certain personal information to the Company or the relevant Artists, such as your email address, country of residence and postcode (“Fan Information”).
As a condition of each Artist’s right to receive such Fan Information, the Company requires that each Artist agree to the terms set forth in the following section of this Agreement. However, you acknowledge that the Company has no control over the use of Fan Information by Artists, and you further acknowledge and agree that Bandcamp shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of such Fan Information by Artists.
Personal Fan Information – Artists
As part of certain features of the Service, including requiring fans to provide you with email addresses and other personal information in order to access the free download option, you may collect certain types of fan information. As a condition of receiving such fan information, you acknowledge and agree that you will not disclose, rent or sell fan information to third parties, and you will only use fan information in connection with the Artist’s mailing list or Artist’s subscription, to provide fans with general information and news about the Artist, such as upcoming shows, new Music or other Content delivered as part of your Artist’s subscription. You further agree that any email or other communication sent to the Artist’s mailing list or sent as part of the Artist’s Subscription will comply with email marketing laws and will include a mechanism by which the recipient may unsubscribe from the mailing list, as well as clear instructions on how to do so (i.e., a working “unsubscribe” mechanism). You will quickly implement a recipient’s request to no longer receive emails from you and you will not send any more emails to that unsubscribed recipient.
Purchasing and Selling Services
Fees and Payments – General
Afro-riddimz facilitates payments for purchases of Content, including digital Content made available for download through the Service (“Digital Content”), physical merchandise (“Merchandise”) and artist subscriptions. Each such purchase is a “Transaction”, each Transaction involving Digital Content is a “Digital Transaction” and each Transaction involving Merchandise is a “Merchandise Transaction”. Transactions can be made using standard payments or enhanced payments, which are detailed here.
Fees and Payments – Customer.
You may purchase products and/or services from an artist via the Site, including, without limitation, purchases of content, including digital content, merchandise and artist subscriptions.
General Terms and Conditions
The Company encourages all users to keep complete and accurate records of all business transactions.
Each User agrees to indemnify and hold harmless the Company, its shareholders, officers, directors, employees, agents and assigns from and against any and all claims, demands, liabilities, losses, costs or expenses, including, without limitation, court costs and attorney’s fees, asserted against or suffered or incurred by any of them, arising directly or indirectly out of or in any way connected with, allegedly or otherwise, the User’s (a) activities as a User ; (b) breach of the terms of the Agreement and/or (c) breach of or non-compliance with any applicable local law or regulation.
The Company shall not be liable for any failure or delay in the performance of any of its obligations under the Agreement or any other failure to perform hereunder if such delay or failure is caused (directly or indirectly) by circumstances beyond the control of the Company, such as, but not limited to, pandemic, strike, labour unrest, fire, flood, earthquake, storm, power failure, riot, act or order of any governmental or local authority, acts of governmental or military authorities, international sanctions, civil disturbance, acts of terrorism, armed conflict, war or any other cause beyond the reasonable control of that Party (a “Force Majeure Event”).
